Terms of service

Marrow helps pharmaceutical distributors take orders from pharmacies and hospitals, including over WhatsApp, prepare proformas, and manage stock, orders, invoices and deliveries. We keep improving the Service and may change features. If we remove something you rely on, we will tell you in advance.

• Give accurate details when you sign up and keep them up to date.
• Keep sign-in details secret. Each person uses their own account.
• Your organisation is responsible for what its team members do in Marrow. Owners and admins decide who joins and what each role can do.
• Tell us straight away at hello@usemarrowos.com if you think someone has used your account without permission.

As a business using Marrow, you agree to:

• hold, and keep valid, the licences required to store and sell the medicines you list;
• keep your products, prices, stock and batch details accurate, as the assistant quotes from them;
• follow the laws on medicines, including the rules for prescription-only and controlled medicines;
• give your customers notice of how their information is used, and have a lawful basis for the personal information you put into Marrow; and
• follow WhatsApp’s Business Terms, Business Messaging Policy and Commerce Policy: message only customers who have agreed to hear from you, and stop when they ask you to.

The assistant reads orders and prepares replies and proformas from your data and the rules you set, such as the order value above which it waits for your team. It can make mistakes, for example by misreading a handwritten list. You are responsible for reviewing what it holds for you and for the orders you accept, and for choosing review rules that suit your business.

The assistant handles ordering. It does not give medical advice, and you should not configure it to.

You must not use the Service to:

• sell counterfeit, falsified, unregistered or illegally obtained medicines;
• send spam or messages people have not agreed to receive;
• try to access another organisation’s data, or test, probe or overload our systems without our written permission;
• copy, reverse engineer or resell the Service without our agreement; or
• break any law or anyone else’s rights.

Your organisation owns the data it puts into Marrow. You allow us to store and process it to provide and support the Service, as the privacy policy describes. For your customers’ personal information, we act on your instructions.

ENA OINTING LTD owns Marrow and MarrowOS, including the software, names and logos. If you send us feedback, we may use it to improve the Service without any obligation to you.

The WhatsApp integration runs on Meta’s WhatsApp Business Platform, and you can connect accounting and inventory software. Those services have their own terms, which apply to your use of them. We are not responsible for their availability, or for limits or restrictions Meta places on your WhatsApp number.

Fees are set out in your plan or order with ENA OINTING LTD, plus applicable taxes. If an invoice is overdue, we may suspend the Service after giving you notice.

You can stop using Marrow at any time and close your account by following the data deletion steps. Before your data is deleted, you can ask us for an export of it.

We may suspend or close an account that breaks these terms, puts the Service or other users at risk, or exposes us to legal liability. Where we reasonably can, we will warn you first and give you a chance to fix the problem.

We work to keep the Service available and accurate, but we provide it “as is” and do not promise it will be uninterrupted or error-free, as far as the law allows.

As far as the law allows, ENA OINTING LTD is not liable for indirect or consequential losses, or for lost profits, revenue or data, and our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

We may update these terms. For significant changes we will tell account owners at least 30 days before they take effect. If you keep using the Service after that, the new terms apply.

These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana decide any dispute about them.
